Нешто слично као што има у науци.

Pa mislim, čovek živi od svog rada, ako je produkt njegovog rada ideja, kompleksna ideja, koju ne može svaki šalabajzer da smisli i da mu padne na pamet tek tako, bilo šta na čemu je morao da radi onda je upravo ta ideja ono od čega on živi, ono što prodaje, za hleb, u znoju lica svog. Zar to ne bi trebalo da smatramo imovinom?

I hteo sam da napišem nešto na sam naslov teme, ali sam shvatio da ne razumem razliku između patenta i intelektualne svojine. Jel' može neko da mi objasni? Jel' može biti društvo bez patenata, ali sa intelektualnom svojinom?

"Интелектуална својина" је општи појам "права" аутора на разне врсте "нематеријалних" ствари. Патент је једна конкретна врста закона којим се брани "интелектуална својина". То значи да постоји државна агенција (нпр. "патентни завод") код које можеш да "региструјеш" нешто (под условима које прописују), а онда држава брани то твоје "нешто" од "недозвољене употребе".

Pa eto u hipotetičkom slučaju da ne postoji patentno pravo i dalje bi postojala intelektualna svojina, ali patenti su upravo posledica intelektualne svojine.

Ali opet, pada mi na pamet da i ta meterijalizacija ne mora uvek biti ,,opipljiva", npr. notna partitura, orkestracija, koja mora biti zapisana npr. na papiru, ali papir se ne štiti, ili zapisana na kompu, ali magnetni zapis se ne štiti, ono što se štiti opet je neopipljivo, a to je informacija. Ili na primer algoritam koji rešava neki težak problem

Here’s the rub. All of my cover tunes on Youtube – and anyone’s cover tunes on Youtube are flat out, no questions asked copyright infringement. Yep, if you are not paying for a license, it is copyright infringement. Does not matter if you did it for fun and not for money, does not matter if it is YOU playing the song. Copyright Violation. Period. Grow up if you wnat to argue or think otherwise!

This poses quite a dilemma. My “new fan” traffic comes from people searching the tune titles – not me, as far as I can tell. They find me via the tune connection, and like magic, I have new fans. These infringing videos are critical to my career, as you can see. Few people start out by caring about Adam’s or anyone’s originals – relatively speaking. However when they find my Billie Jean, they flip out!

(EMI told me a one year license for one tune is about $2500. I may even pay for a tune or two – more to come in another blog post.)

So if you do ANY cover tunes AT ALL – you better keep reading and get real with yourself about where it is all heading.
